Judge releases ruling in Talisker Land Holdings and Park City Mountain Resort Lease Dispute
The Summit County District Court yesterday decided the key issues in the lease dispute with Park City Mountain Resort in favor of the Talisker parties. We are pleased with the Court’s determination that PCMR simply did not timely renew the Leases. As the Court stated, “even assuming all of the facts alleged by Greater Park City Company . . . to be true, the Park City Parties had an obligation to strictly comply with the Leases’ renewal provisions, and they failed to do so.”
Unless PCMR can prove that this failure is due to Talisker’s wrongful or deliberate act as opposed to PCMR’s own fault, the lease issue is at an end.
The court also dismissed PCMR’s antitrust suit.
These rulings provide helpful guidance and hopefully pave the way for the parties finally to resolve their dispute in a manner acceptable to both sides and that serves the best interests of the greater Park City community.
If a settlement is not possible, the parties will proceed with the very limited fact discovery permitted by the court. We are confident that we will prevail on such issues as may remain.
